Local Convicted Murderer Loses Another Appeal
Death row inmate Olen Clay Gorby has lost another attempt at getting a new trial. Gorby, a career criminal with 12 aliases, had just been released from a Texas prison when he killed W#. J. Raborn with a hammer at the victim's Mexico Beach mobile home in 1990.

Death row inmate Olen Clay Gorby has lost another attempt at getting a new trial. Gorby, a career criminal with 12 aliases, had just been released from a Texas prison when he killed W#. J. Raborn with a hammer at the victim's Mexico Beach mobile home in 1990.
Investigators tracked and arrested him after he used the victim's stolen credit cards.
During his trial fellow inmate Jerry Wyche testified Gorby told him he didn't like homosexuals and had "beat a dude down with a hammer for being gay." Gorby's appeal attorney claims the prosecutor coerced Wyche to testify, and he later retracted the statement.
But, Friday Circuit Judge Dedee Costello rejected the appeal, saying there was no new evidence submitted for the appeal. She also said there was so much incriminating evidence against Gorby, he would have been convicted without Wyche's testimony.
This is the third time Gorby has tried to get off death row using new evidence claims.
