A local developer has lost his last round in his legal battle to build high-rise condos at Bay Point.
The state's First District Court of Appeals is refusing to certify Joe Chapman's request to take his fight to the state Supreme Court.
This battle has been going on several years.
Chapman had planned to build three high-rise condos at Bay Point ranging from 10 to 12 stories, but the Bay County Commission denied his building requests.
Chapman appealed to the State Cabinet, which also denied the plans.
He then took that ruling to the District Court of Appeals, which backed the Cabinet by a 10 to 1 vote.
Chapman's last recourse was the state Supreme Court, but without the Appeals Court certification, the Supreme Court will not hear the case.
