Bay County is going to court to stop a controversial annexation by Lynn Haven.
The county has been reluctant to go to court to stop annexations, but Lynn Haven's plans to add a 22-acre tract in the Southport area will not go unchallenged.
The waterfront property is located on Grassy Point Road, which is north of North Bay and east of Highway 77.
The county commission’s lawsuit says the property is in county jurisdiction, is surrounded on all sides by the county jurisdiction, and is three-fourths of a mile from the Lynn Haven boundaries. The county also points out the property is in the county's water and sewer service area.
The lawsuit says the annexation across North Bay is illegal because the bay is a major waterway.
The county attorneys describe Lynn Haven’s interpretation of the state annexation rules as "twisted.”
The lawsuit wants the courts to void the annexation and order the city to pay attorneys’ fees.
