Convicted murderer Rufus Miller will not be getting a new trial after all.
In 2004, Miller was convicted of first degree murder in the 2002 death of his friend Bayou George businessman Jerry Brown.
But judge Michael Overstreet ordered a new trial, after the defense claimed it didn't have the opportunity to question a key witness.
Prosecutors appealed Judge Overstreet's ruling to the state First District Court of Appeals, and Monday the district court overruled Judge Overstreet, saying the witness in question was available and the defense was able to question him.
