The former Fire Chief of The Thomas Drive Volunteer will remain in prison after the First District Court of Appeals extinguished his hopes of getting a new trial.
The District Court of Appeals rejected Tim McGarry’s request for the new day in court. He was convicted last year of having sex with underage girls.
A local judge sentenced him to 40 years in prison for three counts of committing lewd and lascivious acts on minor females.
McGarry appealed by his conviction and the 40-year sentence, but the DCA upheld both and rejected his appeals without comment.
