Poker Players Win in Court Fight With the State

Ebro and the other dog tracks in Florida have drawn an ace in their poker battle with a state agency.

The First District Court of Appeals is shooting down an emergency rule banning poker tournaments at the dog tracks.

The DCA says the Department of Business and Professional Regulation failed to prove the tournaments were a threat to the public health, safety or welfare, and therefore the emergency rule banning them was not justified.

The agency had based its actions on an ad which indicated one dog track was holding "no limit" poker tournaments.

Once the state approves, Ebro's owner plans to reinstate the poker tournaments.
