Opening arguments began this afternoon in the case of a local man accused of D-U-I Manslaughter.

The trail of 21-year-old Mikael Cherry got underway this morning with attorneys selecting a 4-women and 3-men to the jury. Cherry is facing 4-charges, including vehicular homicide and DUI manslaughter.

After jury selections the court recessed for lunch, then began opening statements at 3:00. Cherry is accused of leading Beach Police on a chase down Back Beach Road in February 2008. After officers backed off, Cherry allegedly hit and killed 62-year-old Paul Lenz.

Both the prosecution and defense agree that Cherry was in the car, they disagree on whether or not he was driving the car.

Prosecutor Patrick Faucheux said, "Mikael Cherry drove that Volvo right in the back of Paul Lenz's car. Didn't hit him perfectly, right front of the Volvo hits left rear."

Defense Attorney Harry Harper said, "All he's got to do is say Mikael was driving. Jason Shane Reed is a very disturbed young man."

Reed is the prosecution's star witness against Cherry.The trial is expected to continue throughout the week.

I understand that emotions are high on both sides, however, i also heard part of the evidence is that cherry's cell phone was found on drivers side and reids' wallet on passenger side, there is no way after a high speed chase and then hitting a car, and panicking that they could have put the wallet and cell phoen on opposite sides of the car. sounds far fetched. they are on the side they were on. so i am sorry, it is horrible they are so young but they didn't hit a tree, destroy someones house, they killed an innocent victim and they must pay. It is unfortunate that reid was able to make a plea but the bigger "fish to fry" was who was driving. and his cell phone being in the car is not helpful. as for fingerprints, they were dating, his finger prints are probably all over the car. that won't help. and reids should be on drivers side it was his car. anyway, i wish people would just take taxis!!!!
