A 40-year-old co-worker of Leaphart's named Bishop Marvin Carter, Jr. is being charged with the killing.

He's being held without bond on an open count of murder.

Leaphart's brother found the victim in his apartment on Martin Luther King, Jr. boulevard Sunday afternoon.

In the probable cause affidavit police say witnesses reported hearing the 2-men arguing just before Leaphart's death.

The affidavit claims Carter cut Leaphart's throat with a sharp instrument in several places and beat him in the head with a blunt object causing his death.

And witnesses say they saw Carter hiding bloody clothing behind his house before police arrived to arrest him.

Carter fled his residence and was found hiding in a neighbor's tool shed behind his home on east 10th street.

The report also says Carter used Leaphart's cell phone after his death.

The one thing missing from the affidavit is a motive.

Authorities say the two men worked together at a local grocery store.

But they still aren't saying why Carter allegedly killed Leaphart.

The case is most likely headed to a grand jury for a possible indictment.
