Mayan Resort Ruling Overturned
Last year, then-Circuit Judge Glenn Hess shot down plans for a twenty-two story condominium project at Laguna Beach called the Mayan. Friday, the District Court of Appeals in Tallahassee reversed Hess' ruling.

Last year, then-Circuit Judge Glenn Hess shot down plans for a twenty-two story condominium project at Laguna Beach called the Mayan. Friday, the District Court of Appeals in Tallahassee reversed Hess’ ruling.

Five-years ago, during the condo boom, realtors were able to pre-sell all 279 units of the Mayan condominium in record time, before construction began.
But the Mayan never got off the ground, for two reasons.

First, the condo market imploded. Second, a group of neighbors challenged it in court, claiming the Mayan didn't fit in at Laguna Beach and would disrupt their quiet neighborhood.

They argued Bay County commissioners violated the county's comprehensive plan when they approved the project.

The two-acre Mayan property was zoned "seasonal resort" which allows only 15 "residential" units per acre.

Hess ruled that if sixteen units per acre was a violation, then 279-units on two acres would certainly be a violation.

But this morning, the District Court of Appeals sided with the county and the developer, saying the Mayan was classified as a "resort condominium", basically making it a motel.

The court pointed out that, under Florida law, "resort condominiums" are temporary rentals, and not full-time residences, making the Mayan project legal on "seasonal resort" zoned property.

But the decision, according to the developer Bayne Collins, is a moot point because of the bad economy. He says it could be several years before the condos are built.

just saw the chiefs truck from dist 4 (wefd) at the home depot! what is he doing driving it? at my expense? when he doesn't respond to a call in his own dist? something has to be done at wefd if you have no vol. to respond then you need to place an ad in the paper or place an ad on the sign out front of the fire house.

i forgot to add a ps to my comment since the west end doesn't have a fire department anymore we would have to wait on beach;west bay;and thomas drive to respond. i would like wjhg to report on why west end doesn't have a fire department anymore i don't care if it is all vol, what are our tax dollars paying for? would anybody like to answer that question? thanks.

way to go appeals court of course we dont need a 23 story concrete tower with 279 rooms can you see the water pressure drop can you see more traffic on fbr it is just a shame that greed drives this county; we want more rooms,we want more people who don't care about this beach like we do bring more people to tie up traffic in a town that doesn't have a clue on how to deal with a wreck no cops to direct traffic around it we want and need more open beach not buildings that block out the wonderful view maybe this thing will never get built but what about the ones further west on the beach? like the one at kelly st, the one where the old wave crest was i hope they never get built!
