Convicted Marianna Quad murderer Wesley Williams will not receive the death penalty.
Today, Circuit Judge William Wright said there is not enough evidence to prove Williams' participated in the actual killing of 19-year-old Danielle Baker and her three sons.
The news got a mixed reception from the attorneys on both sides.
It's been two months since a jury convicted Wesley Williams of four counts of first degree murder and three counts of aggravated child abuse, and he has yet to be sentenced.
Thursday, Circuit Judge William W right revealed the reason for the delay.
He issued a written order, ruling that Williams will not receive the death penalty.
"In his issued statement on Thursday, Circuit Judge William Wright stated the evidence in the case proves Wesley Williams was present during the quadruple homicides. However, it wasn't strong enough to prove he deserved the death penalty."
Almost 70 witnesses testified during the two week long trial which consisted mostly of circumstantial evidence.
A 12-person jury deliberated for only two hours before finding Williams guilty as charged for the deaths of 19-year-old Danielle Baker and her three sons.
State Attorney Glenn Hess, who is a former judge, says if the case were his, he'd probably make the same decision.
"I know that we did the best we could in trying what we had. Law enforcement did a great job in putting together the available evidence. Larry Basford did a consummate job of trying the case. But you only have so much and with the Edmund/Tison standard for imposition of the death penalty, I think the judge reached the right decision based on the right reasons."
Public Defender Walter Smith, who was anticipating the death penalty, says Thursday's decision both helps and hurts his case.
"On one hand, we're relieved that Wesley Williams will not receive the death penalty. On the other hand, we will not get a direct appeal to the Florida Supreme Court."
Smith will now hand his client's fate over to the appellate court.
"I just have to put faith that the 1st District Court of Appeals will give us the same level of review that I know we would've gotten in the Florida Supreme Court."

Judge Wright still has not set Williams' sentencing date.

That's it Steve. In the UK a judge would have possibly thrown the case out if there wasn't enough evidence to support it, that would mean the jury would be instructed to find him not guilty. This smacks of "We'll keep him here as we think he may have done it but we're not sure so we're not going to kill him, or let this case cost a fortune for the next 15 years. Sorry America, this is what you get when your public prosecuters are elected, not appointed by the state or in our case, The Crown

Soooo, he's just guilty a little bit so we sentence him to life, either he did it or he didnt, man, these judges, how can a person be guilty enough to get life, but yet not guilty?? i dont know, thats a little screwy.
