A Calhoun County jury on Tuesday acquitted a Blountstown man of selling marijuana.

J.D. Owens, 38, was charged with the third-degree felony of sale of marijuana after police said he sold a small amount of the drug to a confidential informant on July 22. Police said the transaction was videotaped.

But Assistant Public Defender Mark Sims argued to jurors that the videotape didn't show a drug deal and there wasn't any other evidence to connect Owens to the drugs.

the calhoun county judicial system is in need of repair. when a probation officer gets caught with pot, meth, and an open bottle of booze, then refuses breath test, dressed in drag by the way, and all charges were dropped due to lack of evidence.(helps if the public defender is your uncle).isn't the refusal an automatic dui?the judge and the former states attorney were law parteners in private prctice.he resigned after a few years due to public outcry, and now is the public defender in the same court.conflict? apparentley not in calhoun county.two cops get fired for abusing a pizza delivery guy for putting anchovies on their pizza(public record)one is now a c.o.and one a sheriffs deputy.these guys went into pizza hut and snatched him up by the shirt in front of everyone in the resteraunt.another cop accused of excessive force and stripped of his badge has now been hired as the investigator for the states attorney office(gun&badge included)....real name withheld due to fear of retaliation!

Really you can't just videotape a couple people having a conversation, or maybe even exchanging unidentifiable items and label it a drug transaction? Even if one guy is mad at the other, and trying to tie the other to a drug charge to escape his own prosecution? Just when we're bordering police state another setback, bummer..... /s

Mark Sims is an outstanding attorney, Why didn't he stay with the State's Attorney Office?
