26-year-old Dennis Peewee Creamer confessed to beating 2-year-old Haleigh Marie Cain to death in December 2008. That videotape was thrown out by Judge Dedee Costello, who ruled authorities violated his right to remain silent.
Even without seeing that confession, a jury found him guilty of felony first-degree murder and aggravated child abuse.
Monday, Costello will weigh arguments in Creamer's sentencing phase, but just like during trial, the beating confession won't be considered.
The State Attorney's office is pushing for the death penalty in this case, calling Creamer's actions heinous, atrocious or cruel.
The toddler took 11 blows to the head, but may have survived if she had received prompt medical attention.
On the witness stand, Creamer's girlfriend said he was the only father figure the little girl ever knew. Prosecutors say this is another aggravating circumstance that should be given weight during sentencing.

FRY HIM!!!!!!THE SOONER THE BETTER. DON'T WASTE OUR TAX DOLLARS HOUSING AND FEEDING HIM FOR YEARS. TORTURE HIM AND THEN FRY HIM. ALL IN ABOUT A WEEK. THIS BEAUTIFUL AND PRECIOUS LITTLE GIRL DID NOT DESERVE THIS. AND IF THEY WERE HAVING SEX AND WAS INTERRUPTED BY THIS LITTLE ANGEL, THEN THE MOTHER HAD TO HAVE KNOWN WHAT WAS GOING ON. THEY NEED TO DIG DEEPER INTO THIS AND DO HER THE SAME WAY.
I am wondering why the mother of this child was not charged with something? Does a parent not have a responsibility to look after a child's needs, safety, and well being? Did she not endanger her child by bringing this person into the house and passing out drunk while he beat her baby to death? I would think even a babysitter would have been charged if she got drunk and did not look out for the child's well being. I seriously doubt that was the first time this man showed any signs of violence. Or that it was the first time the mother got too drunk to care for or protect the little girl. I feel like the mother should be held accountable for exposing her child to a violent man and not being there to protect her because she was so drunk she couldn't remember anything??? Is that not being negligent? Even if there had been no one else in the house, and the child had an accident and died while the mother was passed out drunk, wouldn't she have been charged and held accountable???
