The First District Court of Appeals has unanimously upheld Kimberly Rasley's 40-year sentence for second degree murder.
Rasley shot her husband Randy in the head during a domestic dispute. She claimed he was abusing her and she shot in self defense.
The appeal court rejected her claims that the case was insufficient and shouldn't have gone to trial and her sentence was too harsh.
