A Circuit Court Judge in Tallahassee late Monday afternoon ruled that the amendment on property taxes slated for a January 29th vote was misleading, and it’s been taken off the ballot.

The suite was brought by the mayor of Weston, Florida, Eric Hersh.

The main argument was that the ballot language hid its most important purpose: Phasing out Save Our Homes’ 3 percent assessment cap.

Jon Thomas of the Florida League of Cities had planned to wage a campaign against the amendment. Now the league wants a more thorough study of taxing problems by the Budget and Tax Reform Commission.

State Lawmakers could try and fix the amendment when they are in town to cut the budget in early October.

Monday night, legislative leaders are saying they will decide what course to take after they have read the opinion.
