DeFuniak's Former City Manager Challenges City's Drug Testing Policies

Greg Scoville filed the lawsuit in federal court Wednesday morning.

City Council members fired Scoville September 24th, just days after he was suspended for refusing to submit a urine sample for the drug test. He had been the city planning director since 2006.

Scoville's lawsuit argues his job was administrative, computer based and did not involve carrying a firearm, operating city vehicles or any other safety sensitive tasks.

He claims forcing city employees to take drug tests without any suspicion violates the fourth amendment to the constitution, which protects citizens against intrusive or unreasonable searches without suspicion.

Scoville is asking the courts to declare Defuniak Springs' drug testing policy unconstitutional. He also wants his job back, along with unspecified damages and attorneys fees.
