Judge Refuses To Throw Out Convictions In Bank Fraud Case

A federal judge is refusing to throw out the bank fraud convictions of Terry Dubose, Frank Baker, and Woody West.

District Judge Richard Smoak is also saying "no" to new trials for the men who headed up the failed Coastal Community Bank. They face sentencing August 21 for defrauding the FDIC out of more than $3 million in a failed scheme to save the bank.

Their attorneys had asked Smoak to throw out their convictions because the evidence was insufficent. Smoak found federal prosecutors had offered more than sufficent evidence to gain convictions.
