When you bury someone, it usually looks like this? But over a year later, Penny Phillipp's son's grave looks like this.

"It hurts me and now we have to go through digging him back up and putting him back in the ground again," Phillipps said.

Her son Clyde Phillipp was a still born when he died on November 2nd 2007, which means he died at birth.

He was buried a few days later at Garden of Memories cometary off of the Tyndall Parkway.Since that day, Phillipp has visited her son almost everyday.

Phillipp says she noticed just a few days ago that her baby's vault wasn't buried that far in the ground."

"How far is it suppose to be in the ground? 18 inches from the top and it's three inches from the top," Phillipp said.

She measured it with a stake and you can clearly see the vault isn't buried that far.

Philip claims Kent-Forest Lawn Funeral home in Panama City didn't do a proper job when burying her son.

"It looks like a construction site and if it was their baby it wouldn't look like this," Phillipp said.

We tried to reach out to Kent-Forest Lawn Funeral home but management there declined to comment on this case.

Philip has now contacted the State of Florida and wants help for her son.

In a statement to Newschannel 7 from the Florida Division of Consumer Services, they told us they have received the complaint and are investigating and cannot discuss details of an on-going investigation.

Philip just wants answers and believes the funeral home is just covering up the problem with sand.

"If the guy does his job like this he should be in a construction business not a funeral home business," Phillipp said.

Philip says she just wants the funeral home to admit they made a mistake and properly bury her son.
