Local Doctor Gets His Medical License Back

A local doctor gets good news Friday afternoon. Dr. Daniel Daube's medical license has been reinstated after a suspension earlier this month.

According to attorney Larry Perry, the First District Court of Appeals ruled the State Health Department overstepped its bounds by suspending his license when less restrictive measures could have been taken.

Daube admitted to using a generic form of Botox on 14 patients. Apparently the substance, which the doctor says he ordered in good faith, was a form of botulism not yet approved.

With his license reinstated he will not be allowed to use botulism neurotoxin any longer under the agreement with the state.

The FDA and FBI have both stepped into this case and have shut down the Arizona company that sold the product. The company Made claims its product was pending FDA approval when it had never even applied.

More than 200 doctors across the United States bought the chemical from the company, including several here in Florida.

Dr. Daube’s spokesman says he is resuming his practice in Panama City immediately.
