An appeals court has teamed with Bay County commissioners to stop Lynn Haven from expanding north of the Bailey Bridge.
The First District Court of Appeals has denied Lynn Haven's attempts to annex a 22-acre site in the Grassy Point area.
Lynn Haven successfully jumped North Bay several years ago in annexing the Marina Bay condominium project.
After that move, county commissioners warned local cities they would challenge any future annexations they deemed illegal.
The county argued Lynn Haven could not annex the Grassy Point land because it was not adjacent to the city, as required by state law.
Circuit Judge Glenn Hess agreed the city should not be allowed to jump the bay to annex the land. Wednesday, the District Court of Appeals backed Judge Hess's ruling, denying Lynn Haven's appeal on merits.
