According to Chief Phillip Thorne, Sgt. Mark Fogarty was off duty in an unmarked car Wednesday night when he approached 25-year-old Trudi Foster and offered her a ride.

Foster claims that after she accepted the ride she was handcuffed and raped. She then called 911.

During questioning, investigators say the pair didn't tell the truth about what happened. And come to find out, they allegedly had consensual sex. Thorne was saddened when he heard the news.

"We're disappointed that he made this poor decision. It's on us as an agency, as a profession but it's not indicative of the type of people that we are," Thorne said.

Thorne says 36-year-old Fogarty is a 16 year veteran of law enforcement and has been with the Springfield Police Department for almost four years.

"As a police officer, the integrity issue, credibility issues, character issues, he's finished with this agency unfortunately and I can only wish him well," Thorne said.

Foster was also arrested and charged with lying to law enforcement. Both were booked into the Bay County Jail.

Thorne also said he is sending a report to a civil service board. The board will review the case and make its recommendation to the Springfield City Commission.

Trudi foster is no stranger to the law. Back in 2002 she was accused of killing her three-month-old son by neglect, but Judge Dedee Costello dismissed the manslaughter charge when the state could not present a clear-cut cause of the child's death.

Sgt Fogarty made a mistake, and had a lapse in judgement. it doesn't change the fact that he is a GOOD person. give him a break. wouldn't you want that if it were your loved one? I do not know what he was thinking and at this point I don't care. I just know that I love him and his family, and stand beside them 100%. They will make it through this and with help will come out even stronger. Give him a break. Look at your pasts. Have you always been perfect? When you can say yes to that question, then maybe you can judge someone.

First of all for an officer to LIE to investigators is wrong, period. Yes, he WAS in a dept vehicle when this occurred even thought it was consensual, take it somewhere private. Every place has rules/policies/procedures, etc and you KNOW they are there. How can an officer be trusted with ANY case/court preceeding after lying to his fellow peers, regardless of what the incident was?
