An appeals court is sending a Bay County man’s case back to court for resentencing.
In 2004 66-year-old David Martinelli was sentenced to 17 and a half years in prison for money laundering.
From 1995 to 2000, Martinelli ran three Panama City Beach companies that were supposed to help people sell their businesses.
Investigators say Martinelli would take an upfront fee from the business owners, then do very little to help them sell their business.
The judge ordered Martinelli to pay a $150,000 fine and forfeit $4.4 million in cash and property.
The 11th federal Circuit of Appeals in Atlanta has upheld Martinelli’s conviction but ruled the judge used facts that were not proven to the jury to enhance Martinelli’s sentence.
