Triathlete death goes to court

The civil trial for the 2006 death of Iron man competitor Barney Rice began Monday.

Rice died a few days after losing consciousness during the swimming portion of the triathlon.

Brian Moore filed a lawsuit on behalf of Rice's estate against North American Sports incorporated last summer claiming they were to blame for his wrongful death.

Both sides agree that the death of Barney Rice was a tragedy.

That's one of the few points in this case where there is agreement.

35-year old Barney Rice of Cali Spell, Montana, after competing in the Iron Man Florida triathlon died on November 4th 2006.

Rice became distressed during his second lap of the swimming portion of the race.

He apparently had cardiac problems before he was spotted by another swimmer and pulled from the water by Navy Divers.

Doctors at Bay Medical Center kept rice on life support until November 7th, when he died.

According to the plaintiff's attorney Diana Santa Maria, triathlon officials did not properly staff the event, depriving Rice of the appropriate medical attention in-time to save his life.

Defense attorney Larry Matthews countered saying staffing of the event was adequate.

Matthews also says a doctor will testify as an expert witness that Rice could not have been saved because his heart stopped instantly.

Several dozen witnesses are expected to take the stand in the case, including Rice's widow, who was visibly upset during this morning's opening statements.

The trial is expected to last throughout the week, with a verdict possibly coming on Friday.

There is not a specified amount being sought by the plaintiff's, and Judge Richard Smoak is presiding over this case, while 7 men and 1 woman are serving on the jury.

He did not have cardiac issues...ever, the autopsy evidence will prove that.

Yes Mr Rices' passing was a tragedy, he was young. But these triathaletes know that these races are a test of ones physical endurance. Let me see the autopsy report. Lets see what really killed him. If it was something that was not caused by the water rescue crews & there was nothing they could have done to save him. Sorry no settlement.
