A Bay County Circuit Court jury found Rufus Miller guilty for the December 2002 first-degree murder of Bayou George businessman Jerry Brown.
The guilty as charged verdict came in Miller’s trial back in February of this year. A day later that same 12-member jury recommended the death penalty.
Tuesday, Circuit Judge Michael Overstreet was expected to make a decision on the sentence the jury had recommended, but instead the defense asked for a new trial instead and the state said it was not prepared to argue against the motion.
Since that motion was filed late due to another case decision, Judge Overstreet is allowing the state more time to respond.
