The attorney for the former Panama City firefighter accused of killing his ex-girlfriend says his client is not competent to stand trial.
41-year-old Joseph Moody is charged with the murder of 24-year-old Megan Pettis.
Police say Moody confessed to shooting Pettis in march as she tried to leave the parking lot of the 23rd Street Publix.
Moody's attorney originally entered a not-guilty plea and his trial was set for September but Rusty Shepard now wants his client declared mentally incompetent to stand trial.
He has a doctor who will back up the claim but the state is not buying it.
A pre-trial conference is set for Friday at 1:30 so the judge can decide how to proceed.
