The condition of an eleven-year-old Weaver girl hospitalized after drinking acid allegedly used in meth production has been upgraded to serious.

Children's Hospital in Birmingham said Kristen Michelle Kelley's condition was upgraded from critical Wednesday.

Family members said Kelley drank acid stored in a Sprite bottle while playing outside with a friend on Feb. 13. Her cousin, 42-year-old Wayne Thurman Tubbs, allegedly left it out.

Weaver Police Cpl. Charles Plitt said Kelley has eaten some food and that doctors are examining the damage to her throat.

Plitt said she may need more surgery.

Tubbs was being held in the Calhoun County Jail without bond. He was charged with assault, chemical endangerment of a child and manufacturing meth.
