Murderer Loses Her Second Appeal

A woman who helped plan a robbery that resulted in a Fountain store owner's murder, will not be getting a new trial.

The First District Court of Appeal upheld the conviction and sentence Thursday of 28 year old Amy Beth Cucco.

Cucco and her boyfriend Nicholas Lee, are serving life sentences for the attempted robbery and murder of Sylvia's convenient store owner Vish Patel.

Cucco had worked for Patel at the store on Highway 231 and knew he kept large amounts of cash on hand at the end of the week.

Lee shot and killed Patel as he was walking from his home to the store.

Even though she did not fire the fatal shots, Cucco received life without parole under Florida's felony murder law.

The Appeal’s Court denied her appeal, without comment. This is the second appeal Cucco hs lost.

The Appelate court rejected her 2009 appeal as well.
